Terms of Service
1. Acceptance of Terms
By accessing or using ScaleMedTech (the “Platform”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform. Access to the Platform is granted on an invitation-only basis.
2. Description of Service
ScaleMedTech is an AI-powered market intelligence platform for the medical technology sector. The Platform provides distributor mapping, key opinion leader (KOL) graphs, regulatory pathway tracking, and competitive intelligence, contextualised by asset, indication, and territory. Services are contracted per asset under annual agreements.
3. Access and Accounts
Access to the Platform is granted following execution of a subscription agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at support@scalemedtech.com.
4. Permitted Use
The Platform and its data outputs are licensed for internal business use only. You may not resell, redistribute, sublicense, or otherwise make the Platform or its outputs available to third parties without prior written consent from ScaleMedTech. Systematic extraction or scraping of Platform data is prohibited.
5. Intellectual Property
All content on the Platform, including data compilations, KOL graphs, distributor registries, and analytical outputs, is the proprietary property of ScaleMedTech or its data licensors. Nothing in these Terms grants you ownership of any intellectual property rights in or to the Platform.
6. Data Accuracy
ScaleMedTech applies AI-assisted processing and human analyst review to maintain data quality. However, we do not warrant that all information is complete, accurate, or current. Intelligence outputs are provided for strategic decision support and should not be relied upon as the sole basis for regulated clinical, legal, or financial decisions.
7. Limitation of Liability
To the maximum extent permitted by applicable law, ScaleMedTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if advised of the possibility of such damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your access to the Platform at any time for breach of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will do so.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to Terms
We may update these Terms from time to time. We will notify contracted subscribers of material changes via email. Continued use of the Platform after such notification constitutes acceptance of the revised Terms.
